1. Acceptance of these Terms
- These Terms and Conditions ("Terms") are a legally binding agreement between you ("User", "you") and CarYatri, the operator of the CarYatri app ("CarYatri", "we", "us").
- Registered address: Ward No. 8, Badri Prashad Colony, Bisauli, Budaun, Uttar Pradesh – 243720, India.
- By downloading, registering on, or using the App, you agree to these Terms, our Privacy Policy, and applicable Indian law — including the Information Technology Act, 2000 ("IT Act"), the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 ("IT Rules, 2021"), the Consumer Protection Act, 2019, the Motor Vehicles Act, 1988, and the Digital Personal Data Protection Act, 2023 ("DPDP Act, 2023").
- If you do not agree with any part of these Terms, please do not use the App.
2. Definitions
- "App" / "Platform": the CarYatri mobile app and its services.
- "User": anyone registered on the App, as a Driver, a Rider, or both.
- "Driver": a User who publishes a ride offering seats in their own private vehicle.
- "Rider" / "Co-traveller": a User who books a seat on a Driver's ride.
- "Ride": a shared, cost-sharing journey published on the App.
- "Booking": a Rider's request for a seat, confirmed automatically (Instant Booking) or approved by the Driver.
- "Instant Booking": a ride set up so Bookings are confirmed without the Driver reviewing each one.
- "Cost-share": the amount, if any, a Driver asks a Rider to pay, limited under Section 4 to actual, reasonable, proportionate running costs.
- "Services": ride-matching, communication, verification, ratings, and related App features.
3. Eligibility
- You must be at least 18 and able to enter a binding contract under the Indian Contract Act, 1872.
- Drivers must hold a valid driving licence and a validly registered vehicle with current insurance, pollution-under-control (PUC) certificate, and any other legally required permit.
- You must not be barred by law from using the Services, and your registration details must be true, accurate, and current.
- The Services are meant for rides within India. For any ride crossing an international border, you alone must ensure your vehicle, insurance, and documents comply with every country's laws.
4. Nature of the Platform — Carpooling, Not a Taxi Service
- CarYatri is a technology intermediary under Section 2(1)(w) of the IT Act, 2000, connecting private vehicle owners with co-travellers who want to share a journey and its cost.
- We are not a taxi operator, cab aggregator, common carrier, or public transport provider, and we do not own, lease, or operate any vehicle on the App.
- Rides must be genuine, non-commercial cost-shares. Any contribution must be limited to a fair share of fuel, tolls, parking, and running costs for that trip — never a profit.
- As a Driver, you must bear your own proportionate share of the cost too.
- Running a de facto taxi or for-hire service is prohibited. If your ride frequency, vehicle, or amounts suggest commercial gain, we may ask for supporting documents and restrict or suspend your account (Section 26).
5. Role of CarYatri as an Intermediary
- We only help a Driver and a Rider going the same way find each other. We connect people — we do not transport them and we are not their agent.
- CarYatri is not a party to any arrangement between a Driver and a Rider, and does not offer, undertake, or supervise any ride.
- These Terms create no agency, partnership, joint venture, or employment relationship between CarYatri and any User, or between Users.
- We cannot verify or guarantee the accuracy or legality of a ride's route, timing, seats, or cost-share, or any User's identity, character, or driving ability.
- Every ride is the sole responsibility of the Driver and Rider concerned. We are not liable for inaccurate ride information, cancellations or changes, or any User's conduct before, during, or after a ride (see also Section 24).
- You have no recourse against CarYatri for any part of a ride arrangement — including cancellations, late changes, no-shows, or unpaid cost-shares. These are for the Driver and Rider to resolve (Section 27).
6. Account Registration
- Register with a valid mobile number and email and complete OTP verification.
- Keep your login details confidential — you are responsible for all activity on your account.
- Tell us immediately at support.caryatri@gmail.com if you suspect unauthorised use of your account.
- One account per User. Creating extra accounts to get around a suspension, rating, or verification is prohibited.
- You agree that we may contact you by call, SMS, WhatsApp, push notification, or email about your account and the Services. Support-line calls may be recorded for quality and training.
- You can control what you receive under Manage your Account → Communication preference.
7. Identity and Document Verification (KYC)
- We may ask for identity or vehicle documents (e.g. Aadhaar number, PAN, Driving Licence, vehicle registration) and may use third-party providers to verify them.
- These are sensitive personal data under the IT (Reasonable Security Practices and Sensitive Personal Data or Information) Rules, 2011 and the DPDP Act, 2023, collected only with your explicit consent for identity verification, safety, and fraud prevention.
- You confirm every document you upload is genuine, current, and lawfully yours. Forged, altered, or someone else's documents are a serious violation and may be reported to the authorities.
- Drivers agree to show their driving licence, registration certificate, insurance, and PUC certificate to a Rider who asks before a ride.
- A document's photo or scan is used only briefly (including by a third-party processing service, where needed) to read and cross-check its details, then deleted immediately. We keep only the extracted details.
- Under the Aadhaar Act, 2016, giving your Aadhaar number is voluntary — you may use your Driving Licence instead, and we never deny the Services for not providing Aadhaar.
- We do not perform Aadhaar authentication with UIDAI (no OTP or biometric check). Reading the number you upload is not equivalent to, and does not carry the assurance of, government-verified Aadhaar authentication.
8. Driver Requirements and Vehicle Standards
- To publish a ride, you must hold a valid driving licence and be the vehicle's principal driver for the whole ride.
- You must own the vehicle or have its owner's express permission to use it for carpooling.
- The vehicle must have comprehensive insurance covering occupants and third-party liability, a valid PUC certificate, and be roadworthy and legally compliant.
- Every seat you offer must have a working seatbelt, and you must never carry more passengers than the registered seating capacity.
- You must have no medical condition or incapacity that makes driving unsafe.
- Regulatory guidance treats a co-traveller paying only a proportionate cost-share on a genuinely non-commercial trip as a third-party passenger, ordinarily covered by comprehensive third-party insurance. CarYatri gives no guarantee of this.
- Confirm with your insurer that your policy covers carpooling and treats co-travellers as third parties.
- A standard policy may refuse a claim if you profited from the ride — so never ask for more than your actual, reasonable share of fuel, toll, parking, maintenance, repair, depreciation, and insurance costs.
9. Vehicle Registration Class and Permitted Use
- Under the Motor Vehicles Act, 1988 and central and state rules, a vehicle's registration class (private "non-transport" or commercial "transport") and any permit — not the vehicle type — decide who it may lawfully carry and on what terms.
- Neither class automatically allows carrying every kind of passenger: a commercial registration is not blanket permission, and a private registration does not by default allow an unrelated or paying co-traveller.
- Whether a specific vehicle may carry a co-traveller under a cost-share depends on its registration class, permit (if any), and the rules of the state where it is used — and these vary by state.
- It is solely the Driver's (vehicle owner's) responsibility to confirm, before publishing or accepting a ride, that the vehicle is registered, permitted, and authorised for that use, and to obtain any required registration, permit, or authorisation.
- CarYatri does not verify registration class or permits, does not advise on whether a vehicle may lawfully be used this way, and is not liable for any User's compliance or non-compliance, or any loss, penalty, or consequence of a breach.
- We only show that a Driver and a Rider are travelling the same route at the same time. We do not decide, arrange, or instruct who travels with whom, or compel anyone to accept a match — that decision, and its legality, rest entirely with the Driver and Rider.
10. Publishing a Ride
- You are solely responsible for the accuracy of your ride's details — route, date, time, seats, and cost-share per seat.
- You undertake to actually make the trip as published, using the vehicle and route described.
- Do not publish more than one advert for the same trip, or publish a ride on behalf of another Driver.
- We may decline or remove a ride that breaks these Terms, and may decline or limit booking on a ride where required by a change in law, market practice, or our business considerations.
- If you turn on "Repeat every week", you authorise us to publish the same ride on your behalf on the same weekdays every week, 7 days before each date, until you stop it. Each ride published this way counts as a ride published by you under these Terms.
- You can skip a date or week, edit, or stop a repeating ride at any time from Manage your Account → Recurring rides. We may pause it if nobody books it for 3 weeks in a row; rides already published stay live, and you can resume it anytime.
11. Booking a Ride
- A Rider may request a seat on a published ride. It is either confirmed automatically (Instant Booking) or held for the Driver to approve or decline.
- Where review is needed, the Driver should respond within a reasonable time; an unanswered request may expire.
- Once a Booking is confirmed, the Driver and Rider can chat in the App and, subject to each person's communication preferences, see each other's mobile number to coordinate the ride (see Section 21).
- A Booking is tied to your own account — you cannot name a different traveller. For multi-seat Bookings, you are responsible for everyone travelling under it, and they must also follow these Terms.
- A Booking may not be used to transport goods, packages, or animals in place of a person.
- Pickup, drop-off, and any stops must be agreed through the App. A Driver may not pick up a Rider from, or add a stop at, a location not agreed this way.
12. Cancelling a Ride and No-Shows
- Driver or Rider may cancel a confirmed Booking in the App, and should do so — and tell the other party — as early as possible.
- If a Driver changes a material detail (e.g. route or timing), they must inform every affected Rider without delay. A Rider who disagrees may cancel without owing any cost-share.
- At pickup, both should stay reachable by phone and wait at least 30 minutes past the agreed time before treating the other as a no-show.
- CarYatri does not process or hold payments (Section 15), so we owe no refund for a cancellation or no-show.
- Repeated late cancellations or no-shows may be reflected in ratings (Section 16) or reports (Section 17), and may lead to an account review (Section 26).
13. User Conduct — Driver Commitments
- Make the ride as published, including the agreed route, timing, and pickup/drop-off points.
- Never drive under the influence of alcohol or drugs; drive attentively and within the law.
- Keep your registered phone number reachable, especially around pickup time.
- Do not demand more than the cost-share stated in your ride, and do not ask for payment before the Rider has been safely dropped off (where the App does not handle payment).
- Tell co-travellers immediately about any change to timing or route.
14. User Conduct — Rider Commitments
- Do not distract the Driver or disturb co-travellers, and respect the vehicle and its cleanliness.
- Keep your registered phone number reachable, especially around pickup.
- Do not bring any item, substance, or animal that is unlawful or could endanger the trip.
- Pay the agreed cost-share as arranged, and do not try to negotiate it down after the ride.
- Make sure anyone travelling under your Booking also follows these Terms.
15. Cost-Sharing and Payments
- Any cost-share is paid directly between Driver and Rider using their own UPI or payment method.
- CarYatri does not process, collect, hold, or settle any payment, and is not a payment aggregator or payment system operator under the Payment and Settlement Systems Act, 2007.
- A Driver's payment QR code is shown exactly as the Driver uploaded it. We do not verify that it belongs to the named Driver or the amount paid, and are not liable for payments to a wrong, outdated, or fraudulent QR code.
- Before paying, check that the payee name in your UPI app matches the Driver you are travelling with.
- No paid service beyond the agreed cost-share (e.g. parcel delivery, paid detour, extra pickup or drop-off) unless agreed through the App before the ride.
- You are responsible for settling the cost-share and resolving any payment dispute directly with the other User.
- Never pay through a link received outside the App claiming to be from CarYatri — report it (Section 17).
16. Ratings and Reviews
- After a completed ride, Driver and Rider may rate each other. A rating appears on the recipient's profile once posted.
- We never create ratings on your behalf, and rating is never required to use the App.
- Ratings and comments must be honest and not defamatory, obscene, or unlawful. We may remove ones that break these Terms.
- A pattern of low ratings or credible complaints may lead to an account review (Section 26).
17. Reporting a Ride or a User
- Report a safety concern or a breach of these Terms using "Report ride" on a ride's details, or email support.caryatri@gmail.com for anything else.
- We review reports and may warn, restrict, or suspend the account concerned, or share the report with law enforcement where the law requires.
18. Prohibited Activities
- Offering or seeking rides as a commercial taxi, cab, or for-hire service, or profiting beyond a genuine cost-share.
- Uploading false, forged, or another person's identity or vehicle documents.
- Harassing, threatening, defrauding, or discriminating against any User.
- Transporting illegal substances, weapons, or prohibited goods.
- Contacting Users for anything unrelated to arranging a shared ride — including spam, advertising, or swapping contact details to book outside the App.
- Reverse-engineering, scraping, or extracting data from the App, or interfering with its operation.
- Impersonating any person or entity, or misrepresenting your affiliation.
- Breaking these rules may lead to immediate suspension, loss of pending bookings, and, where warranted, a report to the authorities.
19. Content Standards
- We may review, scan, or moderate messages, ride details, photos, and ratings (including with automated tools) to prevent fraud, provide support, enforce these Terms — such as blocking messages that share phone numbers, links, or payment IDs, or detecting contact-detail swaps under Section 18 — and comply with law.
- Under Rule 3(1)(b) of the IT Rules, 2021, you must not host, display, upload, publish, transmit, or share anything that:
- belongs to another person and to which you have no right;
- is grossly harmful, harassing, blasphemous, defamatory, obscene, pornographic, paedophilic, libellous, invasive of privacy, hateful, or racially or ethnically objectionable;
- relates to or promotes money laundering or gambling, or is otherwise unlawful;
- harms minors in any way;
- infringes any patent, trademark, copyright, or other proprietary right;
- deceives or misleads about its origin, or is patently false or misleading but presented as fact;
- impersonates another person;
- contains viruses or code designed to interrupt, destroy, or limit any computer resource;
- threatens the unity, integrity, defence, security, or sovereignty of India, friendly relations with foreign states, or public order; incites a cognizable offence; prevents investigation of an offence; or insults another nation.
- We may remove such content and take account action under Section 26.
20. Third-Party Services
- The App uses third-party services — Google Maps Platform (routing and navigation), Firebase (authentication and notifications), and WhatsApp Business Platform (verification messages) — each under its own terms and privacy policy.
- CarYatri is not responsible for their acts, omissions, availability, or accuracy.
21. Privacy and Data Protection
- We process personal data such as your name, photo, email, mobile number, and the documents in Section 7, under our Privacy Policy and the DPDP Act, 2023.
- Using the App means some information is shared with other Users, not just with us.
- Your name, profile photo, and rating are visible to Users who view your published ride or are matched with you through a Booking.
- A published ride's route, cities, date, time, seats, and cost-share are visible to anyone searching for a matching ride.
- Mobile numbers are shared only between a Driver and a Rider whose Booking is confirmed, and only until the ride is completed or cancelled — never with other Users.
- You can hide your mobile number or WhatsApp from co-travellers under Manage your Account → Communication preference. In-App chat stays available for a confirmed Booking either way.
- Your email address is never shared with any other User; we use it only for your account, verification, and our communication with you.
- To exercise your rights of access, correction, or erasure, contact our Grievance Officer (Section 28).
22. Intellectual Property
- The App, the "CarYatri" name and logo, and all related design, text, and software belong to CarYatri or its licensors and are protected by Indian copyright and trademark law.
- You may not copy, modify, distribute, or use data-mining, scraping, or similar tools on the App without our prior written permission.
- You own what you post — profile details, photos, rides, ratings, and messages ("Your Content").
- By posting it, you grant CarYatri a non-exclusive, royalty-free licence to host, store, reproduce, and display Your Content solely to operate and provide the Services.
23. Disclaimer of Warranties
- The Services are provided "as is" and "as available".
- Access may be interrupted without notice for maintenance, updates, or reasons beyond our control, and features may be added, changed, or discontinued at any time.
- Map, route, and estimated-time information may not always be accurate.
- Beyond Section 7 verification, we do not verify other User-posted information (ride details, vehicle descriptions, messages), do not endorse any User, and are not liable if it is false, incomplete, or misleading.
- A "Verified" badge only means the User completed our document, email, or mobile verification for that item — it does not guarantee their truthfulness, reliability, or future conduct.
- We do not verify or guarantee any User's driving ability, conduct, or character. You travel with someone met through the App at your own discretion and risk.
24. Limitation of Liability
- To the maximum extent permitted by Indian law, and except for our own negligence, wilful default, or fraud, CarYatri and its officers and employees are not liable for any accident, injury, death, loss, theft, or damage connected with a ride, or for any Driver–Rider dispute.
- CarYatri is not an insurer and provides no additional trip insurance unless expressly stated in the App. Drivers must maintain the insurance in Section 8.
- We are not liable for whether a vehicle's registration class or permit allows its use for a ride, or for any resulting penalty or loss — that compliance is the vehicle owner's responsibility (Section 9).
- We are not liable for any accident or incident, or its consequences, where the Driver's licence, the vehicle's PUC, registration, insurance, or any other legally required document was missing, expired, invalid, or non-compliant — regardless of Section 7 verification. Keeping documents valid is entirely the Driver's responsibility.
- We are not liable for indirect or consequential loss (such as lost profit, business opportunity, or reputation), except where caused by our fraud, wilful concealment, or theft.
- Subject to law, our total liability for any claim is limited to ₹1,000 or the amount you paid CarYatri in the previous three months, whichever is lower.
- Any claim about a ride must be reported within three months of the ride date; later claims will not be accepted.
- Because every Driver must hold valid insurance and our role is limited to connecting Users (Section 5), you accept these limits as reasonable.
25. Indemnification
- You will indemnify and hold harmless CarYatri and its officers and employees against any third-party claim, demand, loss, liability, or penalty (including reasonable legal costs) arising from your breach of these Terms, your breach of any law, or your acts or omissions on the App or during a ride.
- You release CarYatri and its officers and employees from any cost, damage, or liability caused by another User, and waive any claim against CarYatri for it, under any statute, contract, or otherwise.
26. Suspension and Termination
- We may suspend or terminate your account for breaching these Terms, submitting fraudulent documents, credible safety complaints or reports (Section 17), or consistently low ratings (Section 16).
- Where reasonably possible we will tell you why, but we may act without notice if immediate action is needed to protect Users or the App.
- You can delete your account anytime via Manage Your Account → Delete my account.
- Your account is then scheduled for deletion: you are logged out on every device, your upcoming rides without passengers are cancelled, and repeating rides stop.
- You have 30 days to reactivate your account by logging in again. After that, your profile, chats, and personal details are permanently deleted, and past trips appear to co-travellers as "Deleted User".
- Some information may be kept after deletion, only as long as required for legal, safety, or fraud-prevention purposes.
27. Disputes Between Users
- We may, at our discretion, offer non-binding help to Users resolving a disagreement about a ride, but are not obliged to and may stop at any time.
- This is separate from Grievance Redressal (Section 28), which covers your grievances with CarYatri as a platform. A ride itself is a matter between the Driver and Rider (Section 5).
28. Grievance Redressal
- Under Rule 3(2) of the IT Rules, 2021 and Section 3(2)(b) of the Consumer Protection (E-Commerce) Rules, 2020, our Grievance Officer is:

- We acknowledge complaints within 24 hours and aim to resolve them within 15 days of receipt, or any other period set by law.
29. Governing Law and Jurisdiction
- These Terms are governed by the laws of India.
- Subject to the grievance process above, the courts at Bisauli, India have exclusive jurisdiction over any dispute arising from these Terms.
30. Force Majeure
- We are not responsible for any failure or delay caused by events beyond our reasonable control — including natural disasters, government action, internet or telecom outages, strikes, or public health emergencies.
31. Changes to these Terms
- We may update these Terms to reflect changes in our Services or the law.
- The latest revision date is shown at the top of this page, and material changes will be notified in the App.
- Continuing to use the App after a change takes effect means you accept the revised Terms.
32. Severability
- If a court or authority finds any provision invalid or unenforceable, the rest of these Terms remain in full force.
33. Entire Agreement, Assignment, and Waiver
- These Terms and our Privacy Policy are the entire agreement between you and CarYatri about the App, replacing any earlier written or oral understanding.
- Other App content, including Help Center, is for information only and is not part of these Terms.
- You may not assign or transfer your rights or obligations under these Terms.
- We may assign these Terms, in whole or part (e.g. if the business is transferred, merged, or reorganised), without your separate consent, provided your rights are not reduced.
- If we do not act, or delay acting, on a breach, we have not waived our right to act on it or on any future breach.
